Acceptance of Terms
By accessing or using CardBuilder Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and CardBuilder Pro ("we", "us", "our"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
By creating an account or using any part of the Service, you confirm that you are at least 16 years of age and that you have read, understood, and agree to these Terms and our Privacy Policy.
Description of Service
CardBuilder Pro is a software-as-a-service platform that enables users to design, build, and distribute custom dashboard cards for Home Assistant. The Service consists of:
- A visual drag-and-drop card builder integrated with Home Assistant via a custom integration
- A cloud console for managing cards, licenses, and account settings
- A community marketplace for sharing and downloading cards created by users
- Optional Pro features available through paid subscription or one-time purchase
The Service requires a Home Assistant instance with the CardBuilder Pro integration installed. Home Assistant is a separate open-source project not affiliated with CardBuilder Pro.
Accounts & Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate and complete registration information and keep it up to date. You may not use another person's account, create an account using false information, or create multiple accounts to circumvent plan limits.
You must notify us immediately at support@cardbuilder.pro if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
Each account may be linked to one or more Home Assistant instances via a unique fingerprint. Account sharing across unrelated parties is not permitted.
Plans & Billing
Free Plan
The free plan provides access to the core builder functionality with limited marketplace downloads. No payment is required. The free plan may be modified or discontinued at any time with reasonable notice.
Pro Maker (One-Time Purchase)
Pro Maker is a one-time purchase that grants access to all Pro features as described at the time of purchase. The purchase includes 12 months of software updates from the date of purchase. After 12 months, the software continues to function but no further updates are included until an update extension is purchased. Refunds are available within 14 days of purchase if you have not activated the license.
Pro Cloud (Subscription)
Pro Cloud is a recurring subscription billed monthly or annually. Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time via your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except where required by applicable law.
Price Changes
We reserve the right to modify pricing at any time. For subscription customers, we will provide at least 30 days' notice before any price increase takes effect. Your continued use of the Service after the notice period constitutes acceptance of the new pricing.
Taxes
Prices are displayed exclusive of applicable taxes unless otherwise stated. You are responsible for all taxes, duties, or levies applicable in your jurisdiction. For EU customers, VAT will be applied at the applicable rate.
User Content
The Service allows you to create, upload, and store content including card designs, assets, and configurations ("User Content"). You retain all intellectual property rights in your User Content.
By uploading User Content to the Service, you grant CardBuilder Pro a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your User Content solely as necessary to provide the Service to you.
By publishing User Content to the marketplace, you additionally grant other users a non-exclusive licence to download and use that content within their own Home Assistant installations.
You are solely responsible for your User Content. You represent and warrant that: (i) you own or have the necessary rights to your User Content; (ii) your User Content does not violate any third-party intellectual property rights; and (iii) your User Content complies with these Terms.
Marketplace Rules
The CardBuilder Pro Marketplace is a community platform. By publishing cards to the marketplace, you agree to the following rules:
- Cards must be original works or properly licensed from the rights holder.
- Cards must not contain malicious code, trackers, or any form of data exfiltration.
- Card metadata (title, description, tags) must be accurate and not misleading.
- Cards must not promote illegal activity, hate speech, discrimination, or harmful content.
- You may not publish cards that infringe third-party trademarks, copyrights, or other intellectual property rights.
- Attempting to game the download credit system through artificial inflation or botting is strictly prohibited.
We reserve the right to remove any card from the marketplace and suspend any account that violates these rules, at our sole discretion and without prior notice.
Intellectual Property
The Service, including its software, design, branding, documentation, and all content created by CardBuilder Pro (excluding User Content), is the exclusive property of CardBuilder Pro and is protected by copyright, trademark, and other applicable laws.
You may not copy, modify, distribute, sell, sublicense, or create derivative works of any part of the Service without our express prior written consent.
The CardBuilder Pro name, logo, and associated marks are trademarks of CardBuilder Pro. Nothing in these Terms grants you the right to use our trademarks, trade names, or other brand elements.
If you provide feedback, suggestions, or ideas about the Service, you grant CardBuilder Pro an irrevocable, royalty-free licence to use that feedback without restriction or compensation to you.
Prohibited Uses
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Attempt to gain unauthorised access to the Service, its infrastructure, or other users' accounts
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Service
- Use automated scripts, bots, or scrapers to interact with the Service in a way that places excessive load on our infrastructure
- Transmit malware, viruses, or other destructive code
- Circumvent plan limits, including download limits, through the creation of multiple accounts
- Resell, sublicense, or redistribute access to the Service without written permission
- Use the Service in any way that damages, disrupts, or impairs the experience of other users
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy, completeness, or reliability of any content available through the Service.
Some jurisdictions do not allow the exclusion of implied warranties. To the extent such exclusions are not permitted, they apply to the fullest extent permitted by applicable law.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDBUILDER PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO CARDBUILDER PRO IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.
These limitations apply regardless of the legal theory (contract, tort, negligence, or otherwise) even if we have been advised of the possibility of such damages. Some jurisdictions do not permit such limitations, so they may not apply to you in full.
Termination
You may terminate your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.
We may suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the Service.
Upon termination for cause, no refunds will be issued. Upon voluntary termination, any remaining subscription period will continue until its end date.
Sections relating to intellectual property, disclaimer of warranties, limitation of liability, and governing law survive termination.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles.
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of Italy.
If you are a consumer in the EU, you may also make use of the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or via a notice on the CardBuilder Pro website.
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
